This license applies to all versions of epcEdit ("the software").

You should carefully read the following terms and conditions before using the software.  Unless you have a different license agreement signed by Koch & Halstenberg, your use of this software indicates your acceptance of this license agreement.

General

The software and any documentation accompanying this License whether on disc, on any other media or in any other form are licensed, not sold, to you by Koch & Halstenberg for use only under the terms of this License, and Koch & Halstenberg reserves all rights not expressively granted to you. The rights granted herein are limited to Koch & Halstenberg’s intellectual property rights and do not include any other patents or intellectual property rights.

Certain components of the software have been or may be made available by Koch & Halstenberg as Open Source. You may modify or replace only these Open-Sourced Components; provided that you comply with the terms of this License and any applicable licensing terms gouverning use of the Open-Sourced Components.  Koch & Halstenberg is not obligated to provide any maintenance, technical or other support for the resultant software.

You may install the software on an unlimited number of compatible computers. An unlimited number of users may use the software at the same time.

Activation Keys

You have to download an activation key to use the software. You may not relicense, reproduce or distribute an activation key except with the express written permission of Koch & Halstenberg.

Transfer

You may not rent, lease, lend, redistribute, or sublicense the software.

Termination

This License is effective until terminated. Your rights under this License will terminate automatically without notice from Koch & Halstenberg if you fail to comply with any terms of this License. Upon the termination of this License, you shall cease all use of the software and destroy all copies, full or partial, of the software.

Governing Law

This agreement shall be governed by the laws of the Federal Republic of Germany. If for any reason a court of competent jurisdiction find any provision, or portion thereof, to be unenforceable, the remainder of the License shall continue in full force and effect.

Third Party Acknowledgements

Portions of the software utilize or include third party software and other copyrighted material. Acknowledgements, licensing terms and disclaimers for such material are contained in the "online" electronic documentation for the software, and your use of such material is governed by their respective terms.

Disclaimer of Warranty

THIS SOFTWARE AND THE ACCOMPANYING FILES ARE LICENSED "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. Because of the various hardware and software environments into which the software may be put, NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED.
